The family of a St. Joseph, Missouri man, who was killed in a car accident, has reached a $1,000,000.00 settlement of a wrongful death claim pending in Buchanan County, Missouri.
On November 5, 2010, Mr. Griggs was working at MFA Agri Services in St. Joseph, Missouri. Mr. Griggs was struck by Rex Deshon as he was directing Mr. Deshon, as Mr. Deshon backed up his truck to hitch it to a fertilizer tank. Mr. Deshon pressed his gas pedal instead of his brake pedal, and pinned Mr. Griggs between the Deshon truck and a railcar. Mr. Griggs suffered massive injuries, and died within a few hours following the accident.
Defendant Deshon claimed that the MFA lot had an uneven surface that created an unsafe condition, and that Mr. Griggs was partially at fault for standing directly behind the Deshon vehicle as it was backing.
The parties were ultimately able to resolve the claim for $1,000,000.00 at mediation.
