Car or Truck Accidents and Traumatic Brain Injuries

Somewhere in the United States, an individual suffers a traumatic brain injury (TBI) every 15 seconds - over 2 million TBIs each year. A TBI usually results from a severe blow to the head. However, rapid acceleration or deceleration of the head, without the head actually striking anything at all, the type of movement associated with many car accidents, may also cause a TBI. In fact, car accidents and truck accidents account for approximately half of the traumatic brain injuries that require hospitalization. A startling 56,000 people per year die as result of a traumatic brain injury.

A TBI can be a life changing event. Unfortunately, for individuals that suffer brain injuries, as a result of a car accident or a truck accident, recovering fair compensation can be very difficult. Insurance adjusters generally try to downplay the significance of such injuries; especially if it can be argued that the injury is only mild or moderate, or if the victim’s prior medical history indicates that he or she has suffered any type of prior head trauma.

It is often necessary for the victim of a car or truck accident related TBI to obtain an expert opinion to demonstrate not only that the accident caused the injury, but to prove the significance of the injury, the victim’s prognosis, and the need for future treatment. Attempting to negotiate with an insurance company, while trying to recover from a TBI, is simply not a good idea. Insurance adjusters are skilled negotiators, backed up by teams of attorneys. Without legal counsel, the cards are stacked against the TBI victim.
