What Are Your Rights After an Intersection Accident?

What Are Your Rights After an Intersection Accident?

Posted By Montee Law Firm, P.C. || 9-Feb-2017

Intersections involve a lot of moving parts, especially if they are located on busy multi-lane roads. From vehicles traveling in multiple directions, to multiple signals, turn lanes, and crosswalks used by pedestrians or bicyclists, risks of collisions increase significantly in intersections as compared to straight roadways. In Missouri and Kansas City, it’s no different. In fact, a recent study that analyzed crash statistics across Missouri found that Kansas City has approximately 1/3 of the most dangerous interests in the entire Show-Me State.

According to the study profiled in The Kansas City Star, Kansas City sees hundreds of intersection car accidents each year. Here are some details researchers found:

  • 4 of the top 10 most hazardous intersections are in KC.
  • The intersection of I-70 and Blue Ridge Cutoff was ranked the 2nd most dangerous intersection in Missouri (based off data from 2015).
  • Kansas City has 45 of the 200 most hazardous intersections (tied with St. Louis despite being a smaller city).

While officials from Missouri’s Transportation Department say the study lacked in providing a full picture and in calculating all factors behind intersection accidents, including population density, they did publicly state that it serves as reminder to all motorists how dangerous intersections can be. They also reported that the state is continually making efforts to make intersections safer, especially on high capacity, congested roads.

If you or someone you love has had the unfortunate experience of being involved in an intersection wreck, you understand the risks they pose. If you or a loved one were injured, it’s also important to understand your legal rights. Under the state’s civil laws, victims who are harmed by negligence of others have the right to recover compensation for their damages from the at-fault party.

At Montee Law Firm, this is precisely what our Kansas City personal injury attorneys help clients after they have been hurt in preventable intersection accidents, including those that may involve:

  • Pedestrians struck by negligent motorists
  • Bicycle accidents, including when drivers fail to yield when turning
  • Intersection accidents involving a driver who ran a red light
  • Negligent drivers who make turns without ensuring the coast is clear
  • Drunk, drugged, and distracted motorists

If you believe negligence was the root of your accident, you might have legal basis to file a personal injury claim. Intersection accidents can be difficult when it comes to proving fault and liability – especially when defendants and insurance companies dispute claims and the facts of what happened during the incident. This is why it’s important to collect all details, and to speak with experienced lawyers who can help investigate the crash by using accident reconstruction, speaking with witnesses, analyzing surveillance videos from nearby businesses, and engaging in other methods of gathering evidence to support your claim – all while you focus on your recovery and the medical treatment you need.

Over the years, our legal team has been widely recognized for delivering the diligent work ethic and compassionate care clients need during troubling times. With over a century of combined experience, our attorneys have handled a wide range of car accident and intersection accident cases, and we have recovered millions of dollars in compensation for victims.
